Overview

This website (exactblue.com) is operated by ExactBlue Technologies Inc ("ExactBlue", "we", "us"). By visiting the site or buying from us, including through a third-party shopping channel or AI shopping assistant, you agree to these Terms. If you do not agree, do not use the site or place an order.

1. Who may buy

exactblue.com is a business-to-business (wholesale) store. We sell full cases only and do not sell individual kits through this site. Ordering requires an approved wholesale account. We may decline, limit or cancel any order, including orders from buyers we cannot verify.

2. Orders placed through third-party channels and AI assistants

Orders may be placed through channels such as AI shopping assistants. When an assistant places an order on your behalf, you are responsible for confirming the items, quantity, price, shipping address and total. These Terms, our Shipping Policy and our Return and Refund Policy apply to those orders in the same way as orders placed on our website.

3. Products and information

We try to display products, specifications and images accurately. Product use is described in the instructions for use (IFU) supplied with each product. Our test kits must be used as directed and are not a substitute for laboratory testing or professional judgement where regulations require it. Results depend on correct use and sample handling. We do not warrant that descriptions or other content are error-free.

4. Pricing and payment

Prices are wholesale prices per case, shown in the currency displayed at checkout, and exclude applicable taxes and shipping. Shipping is quoted separately (see Shipping Policy). We may change prices at any time. If a pricing or listing error is found, we may cancel the order and refund you in full. Payment is taken at checkout through our payment processor.

5. Taxes

You are responsible for applicable sales tax, GST/HST, VAT, duties and import fees unless we collect them at checkout. Business buyers must supply valid tax-exempt or resale details where claimed.

6. Shipping, risk of loss, returns

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Return and Refund Policy. All orders are shipped FOB (Free on Board) our Cambridge, Ontario facility: title and risk of loss pass to you when the goods are handed to the carrier.

7. Warranty and limitation of liability

Our products are guaranteed to work as described until the expiry date printed on each product when stored and used as directed. Except as stated, products are provided "as is" to the extent permitted by law. To the fullest extent permitted by law, ExactBlue is not liable for indirect, incidental or consequential loss, and our total liability for any claim will not exceed the amount you paid for the product concerned. Nothing here limits rights you have under law that cannot be excluded.

8. Intellectual property

All content, names, logos, labels and instructions on this site belong to ExactBlue or its licensors and may not be copied or used without written permission.

9. Prohibited use

You may not use the site for unlawful purposes, attempt to disrupt it, or use automated tools to scrape or place orders except through channels we have approved.

10. Privacy

Your personal information is handled under our Privacy Policy.

11. Changes

We may update these Terms at any time by posting the new version here. Orders are governed by the Terms in effect when placed.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard in the courts of Ontario, except where your local consumer law gives you the right to bring a claim elsewhere.
